Background Affiliation Status Information Center

BASIC contains Commodity Futures Trading Commission (CFTC) registration and NFA membership information and futures-related regulatory and non-regulatory actions contributed by NFA, the CFTC and the U.S. futures exchanges.

Information regarding IBs, CPOs and CTAs and APs of FCMs, IBs, CPOs and CTAs
Generally, any firm and individual that conducts futures or certain swaps business with the public must be registered with the CFTC. However, the CFTC’s Division of Swap Dealer and Intermediary Oversight issued No-Action letters on October 11, 2012, December 21, 2012, and December 28, 2012, that allow certain firms to conduct futures or swaps business while their applications are pending so long as they have filed their applications by December 31, 2012, and that allow certain APs to conduct futures or swaps business if they file applications by March 31, 2013. If you are doing futures or swaps business with a firm or individual that is not currently registered, you should contact that firm or individual to confirm that you are dealing with a firm or individual eligible to conduct this business under one of the no-action letters.

Information regarding CFTC No-Action letters for certain pooled investment vehicle types
NFA Bylaw 1101 requires NFA Members to conduct business with only those firms and individuals that are registered with the CFTC and Members of NFA, unless they qualify for specific CFTC exemptions. Recently, however, the CFTC’s Division of Swap Dealer and Intermediary Oversight issued several No-Action letters which provide relief from CPO registration for CPOs that operate specific types of pooled investment vehicles.

Please be advised that some claims for relief will not appear in NFA’s BASIC System immediately after being filed. If you are doing business with a CPO claiming relief under these No-Action letters, you should request a copy of such claim for your records.
