VIOLATION OF THE CALIFORNIA UNFAIR COMPETITION ACT, CALIFORNIA BUSINESS & PROFESSIONS CODE, SECTION 17200; STATUTE OF LIMITATIONS; SULLIVAN DID NOT ENGAGE IN UNFAIR BUSINESS PRACTICES; UNCLEAN HANDS; OFFSET; AND SECTION 17200 OF THE BUSINESS AND PROFESSIONS CODE IS NOT A VIABLE CAUSE OF ACTION.

RESPONDENT COLIN SULLIVAN SHALL PAY TO CUSTOMER CLAIMANT $31,798.13. INTEREST SHALL BE CALCULATED ON THE COMPENSATORY DAMAGE AMOUNT ONLY AT THE CURRENT LEGAL RATE PER ANNUM FROM JULY 6, 1995 UNTIL PAID. THE AWARD OF OTHER COSTS REPRESENTS THE NFA FILING AND HEARING FEES OF $3,000 THAT THE CLAIMANT PAID IN COMMENCING THIS ARBITRATION.
