COMPLAINT:
On October 18,2 011, NFA issued a Complaint charging Futures Tech with failing to maintain minimum net capital, file timely financial statements and submit additional information to NFA; and submitting false or misleading information to NFA. The Complaint also charged Futures Tech, Holmes and Crotzer with failing to cooperate with NFA and failing to supervise.
ANSWER:
On November 15, 2011, Futures Tech, Holmes and Crotzer filed an Answer to the Complaint in which they denied the material allegations contained therein.
DECISION:
On May 29, 2012, pursuant to a settlement offer submitted by Futures Tech, Holmes and Crotzer, Futures Tech was ordered never to reapply for NFA membership or act as a principal of an NFA Member, effective immediately. Holmes and Crotzer were ordered not to apply to be a principal of any NFA Member or act in a capacity requiring them to be disclosed as a principal of any NFA Member for five years. If, after five years, Holmes and/or Crotzer apply for principal status with any NFA Member, they were ordered to each pay a $10,000 fine, due and payable in full on or before the date of any such application. No consideration will be given to or action taken on any future application for principal status with any NFA Member until the fine has been paid in full. Holmes and Crotzer were also ordered not to apply for NFA membership or associate membership for two years. | | | |
