COMPLAINT:
On April 2, 2012, NFA issued a Complaint charging GL with failure to maintain required minimum adjusted net capital; failure to notify NFA of its failure to maintain minimum adjusted net capital; failure to maintain current and accurate books and records; and failure to properly terminate APs. The Complaint also charged GL and Eggleston with failure to supervise.
ANSWER:
On April 30, 2012, GL and Eggleston filed an Answer to the Complaint in which they denied the material allegations contained therein.
DECISION:
On September 13, 2012, pursuant to a settlement offer submitted by GL and Eggleston, they were ordered to immediately withdraw from NFA membership and associate membership, respectively. Eggleston was also ordered to withdraw as a principal of GL. GL and Eggleston were also ordered not to apply for NFA membership, associate membership or principal status with any NFA Member for one year. Further, should GL or Eggleston apply for NFA membership, associate membership or principal status with any NFA Member following the expiration of the one-year period, GL and Eggleston were ordered to pay a $40,000 fine, due and payable in full on or before the date of any such application.
