COMPLAINT:
On June 10, 2009, NFA issued a Complaint alleging that DOT failed to maintain the required ANC and failed to maintain current books and records, including monthly net capital computations. The Complaint also alleged that DOT and Kerr failed to adequately supervise DOT's operations.
ANSWER:
On July 13, 2009, DOT and Kerr filed an Answer to the Complaint in which they denied the material allegations contained therein.
DECISION:
On October 8, 2009 DOT and Kerr were ordered to pay a $7,500 fine, for which they are jointly and severally liable. In addition, DOT and any firm of which Kerr is a principal were ordered to only operate as a GIB for thirty months. | | | |
