COMPLAINT:
On October 3, 2007, NFA issued a Complaint charging Stonebridge and Rodriguez with conducting futures business with a suspended NFA Associate and submitting materially misleading information to NFA concerning the activities of the suspended Associate. The Complaint further charged Stonebridge and Rodriguez with failure to supervise. In addition, the Complaint charged Stonebridge and Bassage with making misleading sales solicitations.
DECISION:
On May 7, 2008, Bassage was barred from NFA membership and associate membership and from being a principal of an NFA Member for six months.
After the six-month membership bar, if Bassage becomes an NFA Member or Associate or becomes a principal of an NFA Member, he must pay a $5,000 fine, due and payable thirty days after he is granted NFA membership or associate membership or becomes a principal of an NFA Member. Bassage must also tape record, for one year, all conversations between himself and existing or potential customers; retain the tapes for one year; and make the tapes available to NFA upon request. Only periods of time when Bassage is registered and actively soliciting customers will be counted. | | | |

On February 22, 2008, Stonebridge was ordered to withdraw from NFA membership and not reapply for NFA membership or act as a principal of an NFA Member for two years. If, after expiration of the two-year membership bar, Stonebridge is granted NFA membership or becomes a principal of an NFA Member, it must pay a $25,000 fine. Rodriquez was ordered to withdraw from NFA associate membership and not reapply for NFA membership, associate membership, or act as a principal of an NFA Member for one year.
If Rodgriguez becomes a principal of an NFA Member after his one-year membership bar expires, he shall cause all APs of that firm - and any other firm of which he is a principal - to tape record, for one year, all conversations that occur between them and existing or potential customers; retain the tapes for one year from the date they are created; and make the tapes available to NFA upon request. The one-year taping requirement applies to each and every firm of which Rodriguez becomes a principal and begins on the date he becomes a principal of each firm, respectively. Only periods of time when Rodriguez is a principal of that particular firm and that firm is actively soliciting customers will be counted.
