COMPLAINT:
On June 29, 2012, NFA issued a Complaint charging Atlantas with permitting an individual to act as an AP without sponsoring the individual as an AP of the firm and willfully providing misleading information to NFA. The Complaint charged Atlantas and Hysni with making misleading sales solicitations; exercising discretion over customer accounts without obtaining written authority to exercise such discretion; and failing to supervise. Finally, the Complaint charged Atlantas, Hysni and Joseff with failing to observe high standards of commercial honor and just and equitable principles of trade.
DECISION:
On September 21, 2012, pursuant to settlement offers received from Atlantas, Hysni and Joseff, Atlantas was ordered to withdraw from NFA membership within 30 days from the effective date of the Decision and never again reapply for NFA membership or act as a principal of an NFA Member.
Hysni was ordered to withdraw from NFA associate membership and principal status within 30 days of the effective date of the Decision and not apply for NFA membership or reapply for associate membership or principal status with an NFA Member for seven years from the date of his withdrawal. During this period, Hysni may not act in any capacity requiring registration, nor act as a principal of an NFA Member. If after expiration of the bar Hysni applies for NFA membership or reapplies for NFA associate membership or seeks to again become a principal of an NFA Member, then he was ordered to pay a $100,000 fine, due and payable at the same time Hysni applies for NFA membership or reapplies for NFA associate membership or seeks to again become a principal of an NFA Member. Any future application by Hysni for NFA membership, associate membership or principal status with an NFA Member will not be considered or approved until the fine has been paid in full.
Joseff was ordered not to reapply for NFA associate membership or apply for NFA membership or principal status with an NFA Member for five years. During this period, Joseff may not act in any capacity requiring registration, nor act as a principal of an NFA Member. If after expiration of the bar Joseff applies for NFA membership or reapplies for associate membership or seeks to become a principal of an NFA Member, he was ordered to pay a $50,000 fine, due and payable at the same time Joseff applies for NFA membership or reapplies for associate membership or seeks to become a principal of an NFA Member.
