| COMPLAINT:
On August 31, 2011, NFA issued a Complaint charging FINFX and Wolmarans with failing to cooperate fully and promptly with an NFA audit; using false and misleading promotional material; and posting trading results on FINFX's website which lacked support.
ANSWER:
On September 29, 2011, FINFX and Wolmarans filed an Answer to the Complaint in which they denied the material allegations contained therein.
DECISION:
On March 6, 2012, pursuant to a settlement offer submitted by FINFX and Wolmarans, FINFX was ordered to immediately withdraw from NFA membership and is prohibited from ever again reapplying for NFA membership or acting as a principal of an NFA Member. Wolmarans was ordered to immediately withdraw from NFA associate membership and as a principal of FINFX and is prohibited from ever again reapplying for NFA associate membership or applying for NFA membership or acting as a principal of an NFA Member. | | | |
