COMPLAINT:
On September 30, 2009, NFA issued a Complaint charging Cani with failing to list Smilek as a principal and failing to observe just and equitable principles of trade. The Complaint also charged Raybin with failing to supervise.
ANSWER:
On October 28, 2009, Cani and Raybin filed an Answer to the Complaint in which they denied the material allegations contained therein.
DECISION:
On January 15, 2010, Cani and Raybin were ordered to withdraw from NFA membership and associate membership, respectively, and not reapply for NFA membership, associate membership, or act as a principal of an NFA Member for five years. During the five-year period, Cani and Raybin were ordered to not act in any capacity requiring registration, nor act as a principal of an NFA Member. If after expiration of the five-year period, either Cani or Raybin again become an NFA Member or Associate, or a principal of an NFA Member, they were ordered to pay a $15,000 fine, payable thrity days after either Cani or Raybin is granted NFA Membership or associate membership or becomes a principal of an NFA Member. | | | |
