NOTICE OF INTENT TO DENY REGISTRATION:
On June 19, 2012, NFA's President notified Burke that his 2008 guilty plea to and conviction of the felony offense of Aggravated DUI/Great Bodily Harm disqualifies him from registration under Section 8a(3)(D) of the Commodity Exchange Act.
RESPONSE TO NOTICE OF INTENT:
On June 28, 2012, Burke filed a response to the Notice of Intent in which he requested consideration for settlement and submitted some supporting affidavits.
FINAL ORDER DENYING REGISTRATION:
On November 30, 2012, after a hearing was held in this matter, a Subcommittee of NFA's Membership Committee issued a Final Order in which it ordered that Burke's pending registration application be denied. The Subcommittee found that Burke failed to present sufficient mitigation and rehabilitation evidence at the hearing to show that his registration will not pose a substantial risk to the public. |
