Notice to Swap Dealers and Major Swap Participants regarding changes to NFA's EasyFile Registration Documentation Submission System

As part of the registration process, each swap dealer ("SD") and major swap participant ("MSP") must submit documentation demonstrating its ability to comply with CFTC regulations implementing Section 4s of the Commodity Exchange Act ("4s submissions"). SDs and MSPs file 4s submissions via NFA's EasyFile Registration Documentation Submission System ("RDSS").

Effective March 9, 2015, SDs and MSPs will be able to view all NFA written communications regarding 4s submissions in RDSS. The RDSS Filing Index, which identifies the status of each 4s submission, will now distinguish between active and historical 4s submissions. Active submissions are those which are currently under NFA review or require further action by the firm. Historical submissions are those which do not require any further action by the firm.

In conjunction with the RDSS modifications, NFA will also enhance the manner in which NFA communicates with SDs and MSPs regarding 4s submissions. NFA will no longer email these types of communications directly to firm personnel. Rather, NFA will notify the firm's Chief Compliance Officer and the Compliance Contact provided in NFA's Online Registration System when a 4s submission-related communication is available in RDSS. Upon receipt of NFA's 4s submission notification email, each SD and MSP is responsible for accessing the NFA 4s submission communication via RDSS and responding accordingly. The 4s submission notification email from NFA will include directions on how to access the 4s submission communication via RDSS. In order to implement these changes, RDSS will be unavailable beginning Friday, March 6, 2015, at 8:00 p.m. CST through Monday, March 9, 2015, at 8:00 a.m. CDT.
