Explanation of Proposed Amendments

As the Commission is aware, NFA has recently undertaken the responsibilities to process and grant the registration applications of ATMs and APs of ATMs. The Commission had informed NFA that it believed it would be appropriate for NFA to have the authority to institute adverse registration actions against ATMs, APs of ATMs, and applicants for registration as ATMs and ATM APs. The proposed technical amendments to NFA Registration Rules 201 and 501(a) will allow NFA to undertake this additional function with regard to ATMs and their APs.
