EXPLANATION OF PROPOSED AMENDMENTS

NFA has always believed that customers are better served when NFA can prevent fraud rather than prosecute it. Although NFA already has authority to require Members to file promotional material promptly after its first use, the amendments to Compliance Rule 2-36 provide that NFA may require a Member for any specified period to file copies of all promotional material with NFA for its review and approval at least ten days before its first use (or such shorter period as NFA may allow). This will allow NFA to monitor forex promotional material prior to use rather than after it has already been disseminated to the public, and to target particular Members and their solicitors whose promotional materials are problematic.
