Banc de Binary Restitution Information

NFA is a registered futures association with the United States Commodity Futures Trading Commission (CFTC). NFA is the industry-wide, independent, self-regulatory organization for the US derivatives industry. NFA develops rules, programs and services that safeguard market integrity, protect investors and customers, and help our Members meet their regulatory responsibilities.

NFA operates at no cost to the American taxpayer. NFA’s operations are financed exclusively from membership dues, and from assessment fees paid by the users of the futures markets.

NFA has been Court-appointed as the Monitor to distribute the restitution ordered to be distributed to U.S.-based investors who deposited money in the “Banc de Binary” binary options trading platform (i.e., the Banc de Binary Restitution Fund), as set forth in:

  • the Consent Order for Permanent Injunction, Civil Monetary Penalty and Other Equitable Relief Against Defendants entered in the case U.S. Commodity Futures Trading Commission v. Banc de Binary Ltd., 2:13-cv-00992-MMD-VCF (D. Nev.), and
  • the Judgments against the defendants and the Order granting the SEC’s Unopposed Motion to Establish a Fair Fund and Approve the Distribution of Funds Through a Parallel Action entered in the case Securities and Exchange Commission v. Banc de Binary Ltd., et al., 2:13-cv-00993-RCJ-VCF (D. Nev.).

NFA anticipates that this will be a lengthy process and cautions investors that the distribution of funds will not happen immediately, but at a future date. If you invested with Banc de Binary and:

  • reside in the United States or its territories when you opened or traded in the account; and
  • deposited, on a net basis, more funds into the account than you withdrew out of the account during the time that the account was active,

please submit your contact information to NFA as soon as possible. Send your name, address, telephone number and email address to BDBRestitution@nfa.futures.org. NFA will use this information to issue all future correspondence regarding Banc de Binary, including any restitution you may be entitled to. You may also submit this information in writing to:

All contact information is considered non-public information and is confidential.

If you traded with Banc de Binary and you are entitled to receive a distribution from the Banc de Binary Restitution Fund, you do not have to pay any amount of money in order to receive a distribution from the fund.
